Terms & Conditions

These Terms & Conditions apply to all memberships, casual passes, bookings, and use of Kingston Gym + Swim (KGS). By joining, booking, or accessing the facility, you agree to be bound by these Terms & Conditions, together with the Privacy Policy, Waiver, and Code of Conduct. If there is any inconsistency between these Terms & Conditions and any promotional material, these Terms & Conditions prevail.

1. Governing Law 

 

These Terms & Conditions are governed by the laws of the Australian Capital Territory.

2. Membership Types & Pricing 

​

  • Membership options, inclusions and pricing are published on the Kingston Gym + Swim website and may change from time to time.  

  • All prices are quoted on a weekly basis and billed weekly unless otherwise stated.  

  • Foundation membership pricing is available for a limited time, subject to capacity, and may be withdrawn or amended without notice.  

  • Memberships are subject to capacity limits and availability.  

  • A one-off signup fee applies to new memberships, as displayed at the time of joining. The signup fee covers administration, induction, access setup (including fob or mobile access) and onboarding. The signup fee is charged once per member and is non-refundable.

3. Payments 

​

  • All memberships are paid by direct debit only via our booking and payment platform (ZenPlanner and Ezidebit). Direct debit may be set up via bank account (preferred) or credit/debit card (Visa or Mastercard). American Express is accepted however attracts a surcharge. 

  • Casual passes may be purchased by credit or debit card. Cash is not accepted. 

  • Failed or dishonoured payments may incur fees charged by the payment provider. These fees are currently $9.90 per dishonour however are subject to change at any time without notice. These fees are the responsibility of the member.  

  • Repeated failed payments may result in suspension or termination of access.  

  • If amounts remain unpaid, KGS may charge a reasonable administration fee and/or interest and reserve the right to refer the outstanding balance to a debt collection agency. Any reasonable costs incurred in recovering the debt, including collection fees, may be payable by the member.

4. Minimum Term, Cancellation & Cooling-Off 

​

  • All memberships have a minimum term of four (4) weeks. 

  • A minimum of four (4) weeks’ written notice is required to cancel a membership. 

  • A limited 48-hour cooling-off period applies from the time of joining, provided no facility access has occurred. If access has occurred, the cooling-off period does not apply.

5. Membership Suspension (Pauses) 

​

  • Memberships may be suspended for up to four (4) weeks per calendar year, in minimum blocks of two (2) weeks. 

  • At least two (2) weeks’ notice is required to request a suspension. 

  • Suspension time does not count toward the cancellation notice period.  

  • Suspensions cannot be backdated.

6. Bookings & Capacity 

​

  • Bookings are required for all facility access, including gym, pool, sauna, ice bath and classes. 

  • Capacity limits are enforced.  

  • Entry without a valid booking does not guarantee access, even if a member holds a valid membership. 

  • If attending across multiple time blocks, multiple bookings are required.  

  • Repeated no-shows or late cancellations will be managed under our three-strike policy, as outlined below:  

  • Strike 1: Verbal warning.  

  • Strike 2: $10 administration fee.  

  • Strike 3: Restricted booking access, suspension, or cancellation of membership, at our discretion. 

  • KGS reserves the right to apply this policy reasonably and at our discretion to ensure fair access for all members.

7. Access Control, Fobs & Tailgating 

​

  • Access is strictly individual. Each person must use their own fob or mobile access to enter. 

  • Tailgating (entering the facility without scanning your own access after another person) is prohibited. 

  • Lost or compromised access must be reported immediately.  

  • Replacement fobs or mobile access setup may incur a $50 fee.  

  • CCTV is in use for safety, monitoring and compliance purposes.

8. Casual Passes 

​

  • Casual passes are subject to availability and capacity limits.  

  • Each casual session allows:  

  • Gym access: up to 1 hour 

  • Pool or sauna: up to 30 minutes  

  • Ice bath: up to 15 minutes 

  • Extended use requires additional passes.  

  • Casual passes are non-transferable and valid only within their stated validity period.

9. Free Trials & Promotional Offers 

​

  • Any free trial, promotional access or complimentary pass is subject to separate terms and conditions applicable to that offer, including eligibility, inclusions, capacity limits and start dates. 

  • Free trials are intended for local individuals genuinely considering membership, not visitors or guests (who would need to purchase a casual pass). 

  • Kingston Gym + Swim reserves the right to limit, modify or withdraw promotional access at its discretion.

10. Age Limits & Children 

​

  • Minimum age for independent use of the facility is 16 years.   

  • Members under 18 must have parental or guardian consent.   

  • Children under 16 are permitted only during between 9:30am-11:30am daily, and only when accompanying a parent or carer. 

  • This access is intended for parents or carers training with prams or pre-school-aged children, not for children to use the facility. 

  • Children must be supervised at all times and may not use equipment or facilities.  

  • These requirements are insurance-driven and strictly enforced.

11. Personal Training 

​

  • Only Kingston Gym + Swim approved trainers may conduct personal training sessions within the facility. 

  • External trainers are not permitted and will be asked to leave the facility. 

  • Personal training sessions require payment upon attendance.  

  • Cancellations with less than 24 hours’ notice incur the full session fee.

12. Member Responsibilities 

​

  • Members must comply with all facility rules, safety requirements and the Code of Conduct.  

  • Members must follow staff instructions at all times.  

  • Equipment must be used correctly and returned after use.  

  • Showering is mandatory before entering the pool, sauna or ice bath.  

​

13. Health & Safety 

​

  • Members participate at their own risk and are responsible for ensuring they are medically fit to exercise.  

  • Members must complete a waiver before accessing the facility.  

  • Kingston Gym + Swim may refuse access if it believes continued participation poses a safety risk.  

​

14. Personal Property 

​

  • Kingston Gym + Swim is not responsible for the loss, theft or damage of personal belongings.  

  • Lockers are provided for convenience only and are used at the member’s risk.  

​

15. Suspension or Termination by Kingston Gym + Swim

 

  • Kingston Gym + Swim may suspend or terminate access without refund for: 

  • breaches of the Code of Conduct,  

  • unsafe behaviour,  

  • non-payment,  

  • misuse of facilities,  

  • providing false or misleading information.  

  • Serious breaches may result in immediate termination.

16. Changes to Terms 

​

  • Kingston Gym + Swim may update these Terms & Conditions from time to time.  

  • Members will be given at least four (4) weeks’ notice of material changes where required.
